1. Acceptance of Terms

By accessing or using The One Day Will platform at theonedaywill.com, you agree to be bound by these Terms of Use. If you do not agree, do not use this platform.

2. Not a Law Firm

The One Day Will is a technology platform operated by 10438600 Canada Inc. It is not a law firm and does not provide legal advice. Use of this platform does not create a solicitor-client relationship between you and 10438600 Canada Inc. The lawyer-client relationship is formed solely between you and the licensed Ontario lawyer assigned to your file through this platform. Clients are required to initial their acknowledgment of this disclaimer before proceeding with any Will or Power of Attorney questionnaire.

3. Eligibility

You must be at least 18 years of age and have legal capacity to enter into contracts to use this platform. By using this platform you represent that you meet these requirements.

4. Services

The One Day Will provides a technology platform that facilitates the preparation of Wills and Powers of Attorney by independent licensed Ontario lawyers. The platform fee and the lawyer fee are separate and charged by separate invoices. The One Day Will does not share in lawyer fees. All fees are subject to HST.

5. Pricing

Current pricing is as follows:

  • Single Will: $499 ($125 platform fee + $374 lawyer fee)
  • Mirror or Mutual Wills: $699 ($175 platform fee + $524 lawyer fee)

POA add-ons:

  • One POA type (Property or Personal Care) for one person: +$99 ($25 platform fee + $74 lawyer fee)
  • Both POA types (Property and Personal Care) for one person: +$149 ($37 platform fee + $112 lawyer fee)
  • Both POA types for both spouses (Mirror or Mutual Wills orders): +$249 ($62 platform fee + $187 lawyer fee)

All fees shown are total fees and include both the platform fee and the lawyer fee, charged as two separate invoices. All fees are subject to HST. Pricing is subject to change without notice.

6. Independent Lawyers

Lawyers available through this platform are independent licensed professionals. They are not employees, partners, or agents of 10438600 Canada Inc. The One Day Will does not supervise, control, or take responsibility for the legal services provided by lawyers through the platform. Legal services are governed by the Law Society of Ontario Rules of Professional Conduct.

7. No Guarantee of Outcome

The One Day Will makes no representations regarding the suitability of any Will or Power of Attorney for your specific circumstances. Estate planning is a legal matter and outcomes depend on your individual situation and applicable law.

8. User Responsibilities

You agree to:

  • Provide accurate and complete information in your questionnaire
  • Review all documents prepared on your behalf before signing
  • Attend your scheduled Will review and execution appointment
  • Notify us promptly of any errors or changes to your information

9. ZipFields

If you choose to import personal information from your ZipFields vault, you consent to the transfer of that data to this platform. You may revoke ZipFields access at any time through your ZipFields account. The One Day Will is not responsible for the accuracy of data imported from ZipFields.

10. Payments

Payments are processed securely through Stripe. By submitting payment you authorize the charges described. Platform fees are non-refundable once your questionnaire has been submitted to a lawyer. Lawyer fees are subject to the lawyer’s own refund or cancellation policy.

11. Privacy

Your use of this platform is also governed by our Privacy Policy, available at theonedaywill.com/privacy-policy.

12. Intellectual Property

All content on this platform, including text, design, logos, and code, is owned by 10438600 Canada Inc. and may not be copied, reproduced, or distributed without written permission.

13. Limitation of Liability

To the maximum extent permitted by law, 10438600 Canada Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of this platform. Our total liability to you shall not exceed the platform fee you paid for the transaction giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless 10438600 Canada Inc., its officers, directors, and agents from any claims, damages, or expenses arising from your use of the platform or your breach of these Terms.

15. Governing Law

These Terms of Use are governed by the laws of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

16. Changes to These Terms

We may update these Terms of Use at any time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms.
