Frequently asked questions

ABOUT THE SERVICE

What is The One Day Will? +
The One Day Will is a technology platform that helps you create a real, professionally drafted Will at a fraction of the traditional cost. You complete a thorough questionnaire, we generate your draft, and an independent licensed lawyer reviews it with you by video call and approves it. You then sign on that same call.
Is this a real Will or a template? +
It is a real Will, drafted to your specific situation based on your answers to our questionnaire. It is not a fill-in-the-blank template. Your answers determine the structure and content of your Will, which is then reviewed and approved by an independent licensed lawyer before you sign it.
Who reviews my Will? +
An independent licensed lawyer in your province or state reviews your draft with you by video call, makes any necessary adjustments, and approves it before you sign.
Is the lawyer independent? +
Yes. The lawyer who reviews your Will is an independent licensed lawyer — not an employee, partner, or agent of The One Day Will platform. You are the lawyer’s client. The lawyer’s fee is paid directly to the lawyer, separately from the platform fee. This structure ensures the lawyer’s duty of loyalty runs entirely to you.

THE PROCESS

How does the process work? +
There are five steps. First, you complete our questionnaire — this takes at least 60 minutes and is thorough by design. Second, we use your answers to generate a professionally drafted Will. Third, you pay and book your appointment by selecting an available time slot on the calendar — your lawyer is automatically notified. Fourth, your independent licensed lawyer reviews your draft with you on the video call, makes any necessary adjustments, approves it, and acts as one of the two witnesses when you sign. Fifth, you receive a reporting letter summarizing your Will and the signing process.
How long does the questionnaire take? +
At least 60 minutes. This is intentional — your Will is only as good as the information behind it. We ask thorough questions so that your Will accurately reflects your wishes and covers your specific situation.
Can I save my progress and come back later? +
Yes. You can save your progress at any point and return to complete the questionnaire later. Your answers are stored securely and will be waiting for you when you come back.
What happens after I submit the questionnaire? +
Once you submit your questionnaire, you will be directed to pay and then to our booking calendar. You choose an available time slot that suits you, and your lawyer is automatically notified of the appointment. Your lawyer keeps their availability updated at all times so that the slots shown are always accurate.
How do I sign my Will? +
You sign your Will by video call with your independent lawyer and one additional witness present. Your lawyer acts as one of the two required witnesses. The signing is done by Zoom and your lawyer will guide you through the process to ensure your Will is properly executed and legally valid.

PRICING & FEES

Why are there two separate fees and two invoices? +
The Law Society of Ontario requires that legal fees be paid directly to the lawyer providing the legal service — they cannot flow through a third-party platform. The platform fee covers the questionnaire, document generation, and client portal. The lawyer fee covers the legal review, approval, and signing appointment. These are two separate services provided by two separate parties, and they are invoiced separately to reflect that clearly and comply with LSO rules.
Is HST charged on top of the prices shown? +
Yes. All fees shown are subject to HST. Both the platform fee and the lawyer fee attract HST, and each will be shown separately on their respective invoices.

LEGAL QUESTIONS

What is the difference between a Mirror Will and a Mutual Will? +
Mirror Wills are two separate Wills — one for each spouse — that mirror each other in structure. For example, each spouse leaves everything to the other, and then to the same beneficiaries if the other has already died. Either spouse can change or revoke their Will at any time without the other’s knowledge or consent. Mutual Wills are also two separate Wills with the same structure, but they come with a binding legal agreement that neither spouse will change their Will after the first one dies. Mutual Wills are much more complex and are not suitable for a streamlined platform. The One Day Will offers Mirror Wills. If you would like a clause in your Will recording an agreement with your spouse about not changing your Wills, this can be discussed with your independent lawyer during the review process.
What is a Power of Attorney and how is it different from a Will? +
A Will takes effect at death — it governs what happens to your assets and your dependants after you die. A Power of Attorney operates during your lifetime, but only during periods of incapacity. If you become unable to make decisions for yourself — due to illness, injury, or cognitive decline — your attorney steps in to act on your behalf. A POA for Property covers financial decisions. A POA for Personal Care covers health and personal decisions. Both documents are important parts of a complete estate plan.
What is a private Will and why might I need one? +
When a Will is probated — that is, when it is submitted to the court after death to validate it and authorize the executor to act — it becomes a public document. Some assets, such as shares in a private corporation, can be transferred outside of probate using a separate Will that is never submitted to the court. This is called a secondary or private Will. Whether you need one depends on your specific situation and will be explored during the questionnaire process. If a private Will is recommended, there will be an additional fee which will be discussed with you before it is incurred.
Which provinces and states do you serve? +
The One Day Will currently serves clients in Ontario. We are expanding to additional provinces and states — check back for updates.
